The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant, brother of the deceased, stated that the petitioner called Bhagwan Rai, the deceased, and took him to market. The informant saw Bhagwan Rai taking wine with petitioner, Pramod Sah, Laxmi Sah and Bhola Sah but his brother did not return. On the next day his dead body was found near a pond.

It is submitted that except suspicion there is no material to show the involvement of the petitioner. Similarly situated accused Pramod Sah, Laxmi Sah and Bhola Singh have already been enlarged on bail and the case of petitioner stands on

Patna High Court Cr.Misc. No.39780 of 2015 (2) dt.07-09-2015 2/2 the same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sitamarhi in Riga P.S. Case No. 76/ 2014 (Prabhat Kumar Jha, J) BKS/- U T
