JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioner is languishing in custody since 07.11.2014 in connection with Mokama P.S. Case No. 21 of 2014 for the offences instituted under Sections 366(A), 120(B), 376(G) of the I.P.C. and 6,8 and 9 of POSCO Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 28.01.2014 Pankaj Paswan alongwith other two boys forcibly kidnapped informant's minor daughter for the purpose of marriage and when informant went to the house of Pankaj Paswan and told about the incident then the mother of Pankaj Paswan flatly told to the informant that her son has kidnapped informant's daughter and became furious.

No.24629 of 2015 (3) dt.19-08-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.11.2014 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner has got no criminal antecedent. The victim girl has been examined under Section 164 Cr. P.C. in which she has not named the petitioner.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna in connection with Mokama P.S. Case No. 21 of 2014. U.K./- (Sudhir Singh, J) U T
