Petitioners have filed the modification application for modification of the order dated 20.09.2017 passed in Cr. Misc. No. 41771 of 2017 by which the petitioners, who are father-inlaw and mother-in-law of the deceased, were granted the privilege of bail, subject to the condition that petitioners will appear before the learned Court below during trial as and when required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of their bail bonds. Learned counsel for the petitioners submits that learned trial court is directing the petitioners to appear on each
Patna High Court Cr.Misc. No.22977 of 2018(2) dt.18-04-2018 2/2 and every date irrespective of the condition that petitioners will appear as and when required.
Considering the submission made by the learned counsel for the petitioners, let the condition imposed in the order dated 20.09.2017 be modified to the extent as under:- "Petitioners will appear before the learned Court below during trial as and when required and failure to appear on two consecutive dates when required without assigning any reason will entail cancellation of their bail bonds."
