JUSTICE PARTHA SARTHY ORAL ORDER 25-03-2021 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners have filed the instant application for grant of regular bail in connection with Mufassil P.S. Case no. 153 of 2020 corresponding to G.R. no. 2539 of 2020 registered under section 392 of the Indian Penal Code. As per allegation in the FIR, two accused persons looted the informant of a total amount of Rs. 62,000/- while four persons kept a watch on him.

It is submitted by learned counsel for the petitioners that from perusal of the order of the learned Court below it would transpire that the petitioner's name transpired in

Patna High Court CR. MISC. No.5262 of 2021(2) dt.25-03-2021 2/2 the confessional statement of co-accused Kamlesh Kumar Mandal. No incriminating article has been recovered from the possession of the petitioners who are in custody since 24.7.2020. The petitioners have not been put on T.I Parade and charge sheet has been submitted in the case.

The application for bail is opposed by learned APP for the State. .

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioners together with the petitioners not having been put on T.I. Parade and charge sheet having been submitted in the case, the Court is inclined to enlarge the petitioners on bail. The petitioners are directed to be enlarged on bail in connection with Mufassil P.S. Case no. 153 of 2020 corresponding to G.R. no. 2539 of 2020 on each of them furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Katihar.
