Petitioner seeks regular bail in a case registered for the offences punishable under Sections 25(1-B) (a), 26 ,27 of the Arms Act and Section 323 and 341 of the IPC. Submission is that the petitioner was produced by private persons before the police along with fire-arm. Contention is that production of fire-arm by private persons is bailable offence. Petitioner has got no criminal antecedent. He is in custody since 15.02.2018.
Considering the entire facts and circumstances of the aforesaid case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Rs. Twenty Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.23021 of 2018(2) dt.20-04-2018 2/2 satisfaction of learned Court below where the case is pending in connection with Bithan P.S. Case No. 15 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
