The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named 14 persons including the petitioner and alleged that Ashok Yadav, Manoj Yadav and Saroj Yadav assaulted Bipin Yadav on his head with Lathi and iron rod. Jugi Yadav, Nanhuk Yadav and Dilkhush Yadav assaulted the informant with Lathi causing injury upon the head of the informant. They also assaulted Babaji living with the informant. Bipin Yadav died during the course of treatment. No specific allegation of assault is made against the petitioner. Similarly situated co-accused Nanku Yadav @ Nanahku Yadav,

Patna High Court Cr.Misc. No.39995 of 2015 (2) dt.02-09-2015 2/2 Paremshwari Yadav, Bhubneshwari Yadav @ Bhuneshwari Yadav, Lakhi Chandra Yadav and others have already been enlarged on bail.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S.
