The petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The petitioner is not named in the FIR, but during the course of investigation the looted articles were recovered from the house of Geeta Devi and also from the house of Mamta Devi the petitioner.

It is submitted that Geeta Devi disclosed that her brother had kept the looted articles in her house as well as in the house of the petitioner. Geeta Devi has already been enlarged on bail. The case of the petitioner appears on the same footing as that of Geeta Devi.

No.39904 of 2015 (2) dt.02-09-2015 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S.
