JUSTICE SUDHIR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34, 304B, 498-A and 201 of the Indian Penal Code. Allegation against the petitioner is of torturing and killing sister of the informant due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 11.7. 2014. The trial of the case is in progress. Only two official witnesses are to be examined. General and omnibus allegation has been made against the petitioner.

On behalf of the State and informant, it is submitted that the post mortem examination supports the allegation in the F.I.R. The trial of the case is at the stage of conclusion. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. Any how the trial court (Addl. Sessions Judge-XI, Saran at Chapra) is directed to ensure appearance of the official

The District Magistrate, Chapra, is also directed to take necessary steps in respect to getting the official witnesses produced before the trial court so that the trial in connection with S. Tr. No. 610 of 2014 arising out of Revilganj P. S. Case no. 47 of 2014 may be concluded within a period of nine months from the date of receipt/production of a copy of this order. Let a copy of this order be sent to the District Magistrate, Chapra.
