Petitioner, already in custody, seeks bail in connection with Sherghati P.S. Case No.579 of 2017, registered under Sections 341, 323, 504, 506, 290, 337, 338, 307 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he threw brick bats and other accused assaulted with piece of bamboo. Learned counsel for the petitioner submits that the only allegation is of brick batting against the petitioner, the sole injury not attributed to the petitioner is simple in nature and the petitioner is in custody since 01.11.2017.

Having considered the said facts and circumstances, petitioner Dharmendra Prasad is directed to be released on bail

Patna High Court Cr.Misc. No.7575 of 2018(2) dt.08-02-2018 2/2 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya in connection with Sherghati P.S. Case No.579 of 2017.
