The petitioners seek bail in Brahampura P.S. Case No. 146 of 2019, registered for the offences punishable under Sections 399, 402, 413, 414, 307, 420, 467, 468, 120(B) of the Indian Penal Code and sections 25(1-b)a, 26, 27 and 35 of the Arms Act and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
One country made pistol from possession of petitioner no. 1 namely, Rajeev Ranjan @ Guddu @ Guddu Rai and three live cartridges from possession of petitioner no. 2 namely, Avinash Kumar @ Bhutta are said to have been recovered. It is submitted by learned counsel appearing on behalf
Patna High Court CR. MISC. No.46738 of 2019(3) dt.25-09-2019 2/2 of petitioners that petitioners have falsely been implicated by the police. Charge-sheet has already been submitted. Petitioners are in custody since 01.06.2019 having no criminal antecedent. Considering the facts aforesaid, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Brahampura P.S. Case No. 146 of 2019, subject to the following conditions:- (i) The petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the court below.
(ii) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners. (Prabhat Kumar Singh, J) vinita/- U T
