Petitioner, already in custody, seeks bail in connection with Karai Parshurai P.S. Case No.95 of 2017, registered under Sections 25(1-b)a, (1-aa), 26, 35 of the Arms Act. Allegation in brief is that a country made pistol with live cartridge was recovered from possession of the petitioner and from his house, unfinished country made rifle, two body of the magazine, to live cartridges, two spent cartridges, five khokhas, two drilling machines, triggers in three pieces, one barrel of the gun and other items were recovered. Learned counsel for the petitioner submits that recovery is of one country made pistol and one live cartridge from possession of the petitioner, rest are not from his

Patna High Court Cr.Misc. No.20870 of 2018(2) dt.10-04-2018 2/2 possession; whereas the learned counsel for the State submits that there is recovery from possession of the petitioner of illegal arms and it appears that mini gun factory was being run in the house.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Karai Parshurai P.S. Case No.95 of 2017 pending in the court of learned ACJM, Hilsa, Nalanda. (Arun Kumar, J) S.KUMAR/- U T
