The petitioner seeks bail in a case under Section 363, 366A and other sections of the Indian Penal Code. The petitioner and other accused persons are alleged to have kidnapped the victim but the victim appeared in court and made her statement under section 164 of the Cr. P.C. and disclosed that she left her house alone, went along with the petitioner and has solemnized marriage with the petitioner. The victim disclosed her age to be 19 years in her statement under section 164 of the Cr. P.C.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Dumra P.S.
