The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant, father of deceased Munna Kumar, disclosed that his son was shot dead by Manoj Sahni, Manoj Pal, Manoj Rai, Rakesh Saraf and Rajesh Paswan, the petitioner. The wife of deceased disclosed that Manoj Sahni, her step brother, was running after the life of her husband only because she solemnized marriage against the will of her family members. There appears that there is no eye witness of the occurrence and on suspicion the petitioner has been made accused in this case. Similarly situated accused Manoj Pal has already been enlarged on bail vide order
Patna High Court Cr.Misc. No.39997 of 2015 (2) dt.01-09-2015 2/2 passed in Cr. Misc. No. 10110 of 2015 and the case of petitioner stands on the same footing.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Motihari (East Champaran) in Sugauli P.S. Case No. 381 of 2014.
