====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 17-06-2025 The petitioner and the complainant are present along with their counsels in the Chambers proceedings.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 498(A), 312 of the Indian Penal Code.
3. The instant case arises out of the complaint filed by the opposite party no.2, wife of the petitioner, alleging therein that there was demand of Rs. 2 lakhs along with a bullet motorcycle and the consequent torture upon her.
4. Vide the last order dated 25.03.2025, it would appear
Patna High Court CR. MISC. No.56750 of 2024(7) dt.17-06-2025 2/3 that both the parties had agreed that they would stay together at NOIDA, Delhi and live a peaceful conjugal life. It was also undertaken by the petitioner that he would keep his wife with full honour and dignity and any untoward incident would be viewed seriously against him.
5. Today, the petitioner (husband) and the complainant (wife) are personally appearing and both support the fact that they are staying together as husband and wife at NOIDA, Delhi and are leading a peaceful conjugal life. It is expected that the petitioner would abide by the undertaking given earlier and would keep his wife with full honour and dignity even in future. However, if at any point of time, the complainant (wife) produces any concrete evidence or some serious issue which would give rise to any safety and health concern, she would be at liberty to approach the learned Court below for cancellation of bail.
6. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the
