Learned counsel for the petitioner is permitted to make necessary correction in the bail application in course of the day. The petitioner, already in custody seeks bail in connection with Dhoriya P.S.Case No. 11 of 2018 registered under Sections 395, 397 and 120B of the Indian penal Code. Allegation in brief is that informant had gone to the house of Mangal Pandit to receive consideration money of Rs. 2 lacs as he had earlier sold land to him and while was returning back after taking money then on the way, some persons looted money and it is alleged that this petitioner and others were also sitting in the house of Mangal Pandit and suspicion is raised that they have conspired and committed the said offence. Submission is that except raising suspicion, there is no

No.21158 of 2018(2) dt.11-04-2018 2/2 other material and it is alleged that this petitioner had looted money of the informant and part of the money was recovered from Guddu Chauhan and Awdhesh Chauhan but even they have not named this petitioner in their confessional statement; moreover, petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely , Bihari Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Banka connection with Dhoriya P.S. Case No. 11 of 2018.
