22-06-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 290 of 2019, registered for the offence under Sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, three motorcycle borne miscreants on the point of pistol looted bag of the informant containing cash of Rs. 32,500/- and other articles and also fired upon the driver of informant's car, as a result of which, he (driver) sustained injury in his neck.
It is submitted on behalf of petitioner that petitioner is not named in the FIR and his name has come on the basis of confessional statement of co-accused Vikki Kumar. No looted article has been recovered from the possession of the petitioner.
Patna High Court CR. MISC. No.5155 of 2021(3) dt.22-06-2021 2/2 Petitioner is in custody since 06.09.2019. Chargesheet has been submitted.
However, learned counsel for the State has vehemently opposed the bail petition and submitted that during T.I.P., the petitioner has been identified by the informant. Considering the aforesaid facts and circumstances and the fact that petitioner has been identified by the informant, the bail petition of petitioner is rejected.
