The petitioner has prayed for bail in connection with Bheldi P.S. Case No. 02/2022, instituted for the offence under Sections 363, 365 and 366 of the Indian Penal Code. As per allegation in the F.I.R., it is a case of abduction and commission of rape with the victim.

Learned counsel for the petitioner submitted that petitioner is quite innocent and has been falsely implicated in this case. During course of investigation, victim girl was recovered but she declined for conducting the medical examination in respect of rape.

Learned APP appearing on behalf for the State vehemently opposed the prayer of regular bail and submitted

Patna High Court CR. MISC. No.49454 of 2022(4) dt.06-02-2023 2/2 that it is a case of abduction and victim specifically supported the prosecution case and says that the petitioner committed rape with her and he along with other accused persons taken her to Calcutta forcefully by pressing her mouth. Thereafter, he made physical relation with her without her consent. Having heard the learned counsel for the parties and considering the nature of allegation, this Court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to expedite the trial and conclude the same as early as possible.
