The petitioner has filed the instant application for grant of regular bail in connection with Bidupur P.S. Case No. 201 of 2022 registered under Sections 363 and 366(A) of the Indian Penal Code.

Allegation as per FIR is that the minor daughter of the informant was kidnapped by co-accused Amar Kumar on the pretext of marriage. When the informant along with her family members went to the house of petitioner, he started abusing and threatening them, thereafter this case has been registered against accused persons.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. A statement has been made in para 3 of this petition that petitioner has got no criminal

As per supplementary affidavit which is annexed with this petition, the daughter of the informant and the brother of this petitioner were in love affairs and for the sake of their love they fled away from their house and after recovery of the victim, she solemnized marriage with the petitioner's brother with her own sweet will. The petitioner has no concern with the alleged occurrence and the matter has been compromised between both the parties. The petitioner is languishing in judicial custody since 17.06.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bidupur P.S. Case No. 201 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
