2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 147, 148 , 323 , 379, 308 , 457, 380 , 504 and 34 of IPC .

3 . The prosecution case in brief, is that on the alleged date and time of occurrence , all the F.I.R. named accused persons including this petitioner entered the house of informant, assaulted her and snatched her mangalsutra . It is further alleged that this petitioner tried to strangulate the informant by pressing her neck and also tried to outrage her modesty .

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Petitioner is own brother of husband of informant and there is

No.47888 of 2025(2) dt.05-08-2025 2/2 partition dispute between them for which a title suit No. 682 of 2019 is pending the Court below and just to settle the aforesaid civil dispute , this false and concocted has been lodged against this petitioner. Allegation of assault is general and omnibus against this petitioner. Rest of the allegation are ornamental in nature .

5 . Learned counsel for the State opposed the bail petition .

6 Considering the backdrop of the case , relation between the parties, and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Sasaram Rohtas in connection with Chenari P.S. Case No. 319 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
