The petitioner apprehends his arrest in connection with Complaint Case No.1252 of 2015, registered for the offence punishable under Section 498(A) of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The petitioner along with other in-laws tortured the complainant physically and mentally for non-fulfillment of demand of additional dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has filed a divorce case in the court of learned Principal Judge, Family

Patna High Court CR. MISC. No.59515 of 2021(2) dt.13-05-2022 2/2 Court, Gaya being M.T.S. No.137 of 2014 and the learned Family Court, Gaya has granted interim maintenance of Rs.5000/- (rupees five thousand) per month to the complainant and thereafter the present complaint case has been filed by the complainant.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Complaint Case No.1252 of 2015, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
