2. The petitioner seeks bail in connection with POCSO Case No. 52 of 2024 arising out of Garhara P.S. Case No. 04 of 2024 registered for the offence under Sections 363, 366A of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have kidnapped the victim girl.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and the victim girl, in her statement recorded under Section 164 of the Cr.P.C. has stated that she has eloped with the petitioner on her own.

5. The petitioner is in custody since 6.5.2024.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, Begusarai / concerned Court below in connection with POCSO Case No. 52 of 2024 arising out of Garhara P.S. Case No. 04 of 2024.
