The petitioner has been arrested in connection with Muffasil P.S., Case No. 63 of 2014, registered under Sections 25(1-B)a, 26 and 35 of the Arms Act.
It is alleged that on secret information, the petitioner along with four accused persons were apprehended on Scorpio vehicle and from the possession of petitioner 15 Trica tablets have been recovered and fire arms recovered from other accused persons. Learned counsel for the petitioner submits that petitioner is in jail custody since 27.07.2015 and except this case the petitioner has been made accused in four other cases. Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.8824 of 2016 (2) dt.18-03-2016 the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran at Motihari, in connection with Muffasil P.S. Case No. 63 of 2014, subject to condition that one of the bailors shall be near relative of the petitioner who will file an affidavit to this effect that petitioner shall not indulge in such activity in future. Further condition that petitioner shall file Hazri in the nearest police station once in a fortnight for one year. Further condition that if any such activity is reported then court below shall consider for cancellation of bail bond of the petitioner.
