JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Banshi P.S. Case No. 01 of 2019, disclosing offences under Sections 341, 323, 354, 504, 506 and 34 of the Indian Penal Code. Allegation as per F.I.R. is that while the informant was going for worship, the petitioners teased her and caught hold her and also tore her clothes anyhow, she came back to her house and told the occurrence to the family members and when her family members went to the house of petitioners, they were threatened by the family members of the accused and in the evening, petitioners came to the house of informant and threatened of dire consequence, if they dare to lodge a case against them. Submission of learned counsel for the petitioners is that as a matter of fact that the buffalo of informant was grazing in the

Patna High Court CR. MISC. No.46464 of 2019(2) dt.26-07-2019 2/2 field of petitioners, which was objected by the petitioners, in which, wordy altercation took place and due to which, this present false case has been lodged.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Arwal, in connection with Banshi P.S. Case No. 01 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that they will not make any threatening to the informant or her family members. (Vinod Kumar Sinha, J) sunilkumar/- U
