JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks bail in connection with Raniganj P.S. Case No. 146 of 2015, registered for the offences punishable under Sections 399, 402, 353, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, police on information of preparation of dacoity went at the place of occurrence and saw 6-7 persons sitting on verandah of school and seeing police party they started firing on police party and causing injury to one police personnel and two persons were arrested and from them loaded pistol and other articles were recovered. It further appears that petitioner is accused in 23 other cases. Submission of learned counsel for the petitioner is that so far this case is concerned, except confessional statement there is nothing against him and he is in custody for almost four years.

Patna High Court CR. MISC. No.46990 of 2019(6) dt.20-02-2020 2/2 Heard learned APP and perused the report of learned trial court from which it appears the case is at the stage of charge.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria, in connection with Raniganj P.S. Case No. 146 of 2015 on the condition that once he is released from custody he has to appear before police station of his local area in second week of every month for a period of one year so that police may watch his activities and further condition that he has to appear before the trial court as and when required and on failure to comply with the above two directions, prosecution is at liberty to move for cancellation of his bail bonds. Let a copy of this order be communicated to the Superintendent of Police, Araria as well as learned trial court forthwith.
