Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of eight weeks.

This application has been filed for modification of order dated 19-01-2021 passed in Cr. Misc. No. 790 of 2020 by which, the petitioner was directed to deposit Rs. 5,00,000/- (five lacs) in two installments. The first installment of Rs 2,50000/- was to be deposited within six weeks from the date of order i.e. 19-01-2021 and the second installment of Rs. 2,50000/- was to be deposited within three weeks thereafter.

It is submitted on behalf of the petitioner that the first

No.59302 of 2021(2) dt.15-11-2021 2/2 installment of Rs. 2,50,000/- has already been deposited by the petitioner within stipulated time but due to Covid-19 & lockdown, the petitioner could not be able to deposit the second installment of Rs. 2,50,000/- within the time frame. Hence, the petitioner prays for further time to deposit the second installment of Rs. 2,50,000/-.

Accordingly, the order dated 19-01-2021 passed in Cr. Misc. No. 790 of 2020 is modified to the extent that further six weeks' time is granted to the petitioner to deposit the second installment of Rs. 2,50,000/- in light of order dated 19-01-2021 passed in Cr. Misc. No. 790 of 2020. All other terms and conditions shall remain the same as mentioned in the order dated 19-01-2021 passed in Cr. Misc. No. 790 of 2020.
