The petitioner, who is lady, seeks bail in a case registered for the offence under Sections 363, 365, 302, 201, 120B of the Indian Penal Code.

The F.I.R. was lodged against unknown for kidnapping of the son of the informant. Petitioner has been made accused in the case on the basis of confessional statement of co-accused Sharwan Kewat, who has already been granted bail by this Court, vide order dated 07.02.2022 passed in Cr.Misc. No. 59042 of 2021.

It is further submitted that petitioner has been made accused since she is sister of co-accused Sharwan Kewat and there is no direct or indirect evidence against her to show her complicity in the aforesaid crime and she is in custody since

Learned A.P.P. for the State and learned counsel for informant have opposed the bail petition. It is submitted by learned counsel for the informant that the complicity of the petitioner has come during course of investigation and she is none else but sister of co-accused Sharwan Kewat. Considering the fact that petitioner is a lady and she has been made accused only on the basis of confessional statement of co-accused, who has already been granted bail, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Biharsharif, Distt. Nalanda in connection with Sarmera P.S. Case No. 129 of 2021. (Prabhat Kumar Singh, J) anay/- U T
