Petitioner, already in custody, seeks bail in connection with Kanhauli P.S. Case No.108 of 2017, registered under Sections 272 and 273 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioner submits that neither recovery is from the petitioner's possession nor he was apprehended, only he is made accused on the basis of disclosure of his name by co-accused, the petitioner has clean antecedent and he is in custody since 03.12.2017.

Having considered the said facts and circumstances, petitioner Shatrughan Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two
