JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date : 03-07-2019 This application under Article 226 of the Constitution of India has been filed by the petitioner for issuance of direction to the respondent concerned for institution of FIR in terms of the order passed by the learned Chief Judicial Magistrate, Begusarai in Complaint Case No. 408 of 2015. 2.
It has been pleaded by the learned counsel for the petitioner that the petitioner has filed Complaint Case No. 408 of 2015 in the Court of Chief Judicial Magistrate, Begusarai. The learned Chief Judicial Magistrate vide order dated 02.02.2015 sent the complaint filed by the petitioner for
Patna High Court CR. WJC No.151 of 2017 dt.03-07-2019 2/2 investigation under Section 156(3) of the Code of Criminal Procedure, but the police have failed to comply with the order passed by the learned Chief Judicial Magistrate. 3.
A counter affidavit has been filed on behalf of respondent nos. 4 to 6 wherein it has categorically been stated that pursuant to the complaint filed by the petitioner an order was passed by the learned Chief Judicial Magistrate for institution of the FIR whereafter Bakhari P.S. Case No. 236 of 2017 has already been registered against one Rahul Kumar Mishra and five others.
