Petitioner is neither caught on the spot nor anything was recovered from his conscious possession and it is evident from perusal of the first information report that name of the petitioner came in confessional statement of co-accused, Bhanu Yadav @ Rajesh who has already been granted privilege of bail by a coordinate bench of this court vide order dated 20-05-2013 passed in Cr. Misc. No. 45185 of 2013. Moreover, other accused also have already been released on bail by different benches of this court.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.43450 of 2015 (2) dt.21-09-2015 2/2 thousand) with two sureties of the like amount each in connection with Nauhatta P.S. Case No. 21 of 2012 corresponding to Sessions Trial No. 23 of 2015 to the satisfaction of Additional Sessions Judge-VII, Rohtas at Sasaram.
