2. The petitioner is apprehending arrest in connection with Madhopur P.S. Case No. 72 of 2024, dated 13.10.2024, lodged under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023"), pending before the Court of A.C.J.M.-V, Gopalganj.

As per the prosecution, FIR has been lodged against five named accused persons, including the present petitioner, with the allegation that all the accused reached the informant's house and assaulted her and her sons. There is a specific allegation against the present petitioner that he assaulted the
Patna High Court CR. MISC. No.47311 of 2025(2) dt.30-07-2025 2/3 informant with a sword, causing her serious injuries. There is also a further allegation regarding the snatching of her mangalsutra and 1,500 in cash.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the criminal antecedent of the petitioner is clean. It is also submitted that there is a delay of about 15 days in lodging the FIR from the date of occurrence. He further submits that the dispute arose from a minor quarrel between two children, which subsequently led to the present case. He also submits that the injury sustained is simple in nature.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is a specific allegation against the petitioner that he assaulted the informant with a sword with an intent to kill, as a result of which she was badly injured.
6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
7. It is directed to the petitioner to surrender before the Trial Court within a period of 6 weeks from today. In case, the petitioner surrenders within six weeks, then the Trial Court

No.47311 of 2025(2) dt.30-07-2025 3/3 is directed to pass order on his surrender-cum-bail application on the same day without being prejudice that the anticipatory bail of the petitioner has been rejected by this Court and the Trial Court shall pass order on the merit of this case.
