The petitioner seeks bail in Baliya P. S. Case No. 245 of 2017 instituted for the offence under Section(s) 447, 341, 342, 364/34 of the Indian Penal Code.
Learned counsel for petitioner submits that there is general and omnibus allegation against this petitioner in the written report.
The other co-accused of this has already been granted bail by co-ordinate Bench of this Court vide order dated 3.5.2019 passed in Cr. Misc. no.16586 of 2019 wherein, it is mentioned that the witnesses in paragraphs 9,10,18 and 23 of the case diary have not supported the allegations made in the FIR. Learned counsel for petitioner has submitted that victim
Patna High Court CR. MISC. No.46489 of 2019(2) dt.01-08-2019 2/2 has already returned and it has come in the case diary that he had gone to house of his sister.
Petitioner is in custody since 6.5.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Begusarai, in connection with Baliya P.
