The petitioner seeks bail in connection with Madanpur P.S. Case No.493 of 2023 registered for the offence under Sections 379 and 411 of the Indian Penal Code. 3.

As per the allegation in the FIR, informant's tractor bearing Registration No. BR26C8486 and Trailer bearing Registration No. BR26C8487 Engine Chassis No. NGN8504 loaded with bricks got missing from his bricks kiln. 4.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. He further submits that the petitioner is not named in the FIR and the name of the petitioner has been surfaced on the confessional statement of co-accused, namely, Parshuram Singh who has already been granted bail by this court in Cr. Misc. No. 18848 of

Patna High Court CR. MISC. No.55981 of 2024(2) dt.02-08-2024 2/2 2024 vide order dated 21.03.2024. Similarly situated one coaccused has also been granted bail by this Court in Cr. Misc. No. 27540 of 2024 vide order dated 20.05.2024. He further submits that the petitioner is in custody since 23.12.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Aurangabad in connection with Madanpur P.S. Case No.493 of 2023.
