Petitioner, already in custody, seeks bail in connection with Industrial P.S. Case No.100 of 2017, registered under Section 394 of the Indian Penal Code.
Allegation in brief is that unknown thieves committed theft in the night in the house of the informant and also in the process of committing theft caused injury to the daughter of the informant.
Learned counsel for the petitioner submits that there is no recovery from possession of the petitioner, the petitioner was not put on TIP, the only material transpired against the petitioner is the disclosure of his name in the confessional statement of one Akshay Lal Mandal and the confessional statement of the
Patna High Court Cr.Misc. No.15152 of 2018(3) dt.21-03-2018 2/2 petitioner before the police, except that there is no other material and recovery is from Akshay Lal Mandal, moreover the petitioner has no criminal antecedent and he is in custody since 04.12.2017.
Having considered the aforesaid facts and circumstances, petitioner Pintu Kumar @ Pintu Mandal @ Pinta Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Bhagalpur in connection with Industrial P.S.
