JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-11-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 366/34 of the IPC in which charge sheet has been submitted under Section 376 of IPC and Section 4 of the POCSO Act.
As per FIR, the allegation against the accused persons including this petitioner is that they kidnapped the daughter of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case for ulterior motive. The victim girl has been recovered and her statement was recorded under Section 164 of the Cr.P.C., wherein she has disclosed her age about 17-18 years and she has stated that she was in love
Patna High Court CR. MISC. No.53974 of 2023(3) dt.07-11-2023 2/2 with this petitioner. She has specifically stated that she left has house alone out of her own sweet will and met with the petitioner in Mumbai, where he was working. She has married voluntarily with him. She has not raised any finger against the petitioner for any overt act. It is further submitted that victim girl is on the verge of majority. The petitioner has got not criminal antecedent and languishing in judicial custody since 29.03.2023.
Learned APP appearing for the state has opposed the prayer of regular bail and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Purushottampur P.S. Case No. 28 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 7th-cum-Special Judge (POCSO), West Champaran at Bettiah.
