The petitioner apprehends his arrest in Shikarpur P.S. Case No. 197 of 2021, registered for the offences punishable under Sections 420, 406, 376 and 511 of the Indian Penal Code. Prosecution case in brief is that this petitioner is alleged to have attempted to commit rape with the complainant/informant.
It is submitted that petitioner is own brother-in-law (Dewar) of the complainant and due to money dispute this false case has been lodged against this petitioner after five years of the occurrence. From perusal of complaint it appears that informant has not disclosed the date and time of occurrence. Husband of the informant illegally possessed the entire movable
Patna High Court CR. MISC. No.59611 of 2021(2) dt.05-07-2022 2/2 and immovable property and this false FIR was lodged with forged and fabricated allegation. Petitioner has got clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S.
