Petitioner, already in custody, seeks bail in connection with Asthawa P.S. Case No.220 of 2017, registered under Section 414 of the Indian Penal Code.
Allegation in brief is that one stolen motorcycle was recovered from the petitioner.
It is submitted that the petitioner was apprehended on suspicion as there was stampede and he fell down; whereas learned counsel for the State submits that stolen motorcycle is recovered from possession of the petitioner, besides this petitioner has three criminal antecedents of similar nature. Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is
Patna High Court Cr.Misc. No.18541 of 2018(2) dt.03-04-2018 2/2 rejected in connection with Asthawa P.S. Case No.220 of 2017 (G.R. Case No.4056 of 2017), pending in the court of learned ACJM-VI, Nalanda at Biharsharif.
However, the trial court is directed to expedite the trial and preferably conclude the same within nine months. If the trial is not concluded within the stipulated period, the petitioner may renew his prayer of bail.
