Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

No.5535 of 2021(2) dt.26-11-2021 2/3 It is alleged against the petitioners that these petitioners came at the door of the informant and on pointing gun, asked him to compromise a criminal case filed by the informant and when the informant denied, they tried to kidnap the informant and made firing from their pistol in the air. They also fired at the informant but it did not hit him.

It is submitted by learned counsel for the petitioners that petitioners have no concern with the alleged criminal case. It has further been submitted that before registration of the present F.I.R, petitioner No. 1 has registered an F.I.R bearing Barhara (Sinha O.P.) P.S. Case No. 273 of 2020 against the informant under Sections 25(1-B)a/26/27/35 of the Arms Act. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Case No. 314 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
