2. The petitioner seeks bail in a case registered for offence under Section 365 of the Indian Penal Code.
3. The prosecution case, in brief, is that on 03.06.2018 at about 11 AM, son of the informant had gone to purchase certain articles, but he did not return. It is further alleged that in course of search, the informant learnt that his son has been taken away by this petitioner and other four co-accused persons and thereafter, he went to the house of petitioner to inquire about missing of his son, then accused persons abused and tried to physically assault informant.
4. Learned counsel for the petitioner submits that victim has already been recovered and in statement recorded
Patna High Court CR. MISC. No.53662 of 2024(3) dt.25-10-2024 2/2 under Section 161 Cr.P.C., has not alleged any wrong against this petitioner, whereas, the victim, in her statement recorded under Section 164 Cr.P.C., has supported the prosecution case. As a matter of fact, both parties are agnates and due to land dispute, this false and concocted case has been lodged. The Court below has assessed the age of the victim as 26 years Petitioner is in custody since 28.05.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 174 of 2018.
