Petitioner is not named in the first information report but in course of investigation, name of this petitioner surfaced. Learned Ist Additional Sessions Judge has referred several paragraphs of the case diary, which go to show that petitioner and some other accused were seen near the place of occurrence and except the aforesaid circumstance, there appears to be nothing against the petitioner.

Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like
