The petitioner seeks pre-arrest bail in connection with Aurangabad Town P.S. Case No.11 of 2016 registered under sections 341, 323, 452, 504, 506, 427 and 307 of the Indian Penal Code.
It is contended that though there is allegation in the first information report that the petitioner assaulted with Garasa on the wrist of the informant, the injury report would suggest that no Garasa injury was caused upon the informant. Patna High Court Cr.Misc. No.12110 of 2016 (2) dt.18-03-2016 2/2 Ray it has been found that there is fracture of 3rd metatarsal of left foot and, accordingly, the fracture is in the finger of the foot and the doctor has opined that the injury was caused by hard and blunt substance. It is further contended that a compromise petition has also been filed in the court below as due to intervention of friends and well wishers good neighbourly relationship has been restored between the parties.
Learned counsel for the State has opposed the application for grant of anticipatory bail.
Regard being had to the nature of injuries, in the event of arrest or surrender before the court below within six weeks from today, the petitioner, namely, Priyanshu @ Hemant Priyasnhu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S.
