Petitioner, already in custody, seeks bail in connection with Maner P.S. Case No.622 of 2017, registered under Sections 147, 148, 149, 152, 188, 341, 323, 307, 332, 333, 337, 338, 427, 441, 353, 504 and 506 of the Indian Penal Code as well as under Sections 3⁄4 of the Damage to Public Property Act. Allegation in brief is that large number of people made protest on the ban of mining of sand and blocked the road causing disruption in the traffic movement and also indulged in brick batting.

Submission is that there is general and omnibus allegation against the petitioner, large number of people were protesting

Patna High Court Cr.Misc. No.16354 of 2018(2) dt.22-03-2018 2/2 and similarly situated other co-accused Santosh Kumar has been admitted to bail by this Court vide Cr. Misc. No.12519 of 2018 on 28.02.2018, moreover the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Gopal Ray @ Gopal Kumar @ Gopal Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in connection with Maner P.S. Case No.622 of 2017. (Arun Kumar, J) S.KUMAR/- U T
