The petitioner seeks bail in K. Nagar P.S. Case no. 58/2015, registered for the offences punishable under Sections 363, 366A, 120B, 34 of the Indian Penal Code.

The petitioner is not named in the FIR. The victim made allegation that Rajesh Kumar Mahaldar and Pramod Mahaldar got her seated on the motorcycle and took her towards Arraria. Both the accused persons kept her confined and took her to different places.

It is submitted that from the statement of the victim it would appear that the victim herself went along with Rajesh Mahaldar and Pramod Mahaldar. She did not raise any alarm nor protested her kidnapping. The victim is a major girl aged about 19 years. Considering the facts aforesaid and the fact that the victim

No.41773 of 2015 (2) dt.15-09-2015 2/2 went along with the petitioner and Rajesh Mahaldar to different places but she did not raise any alarm, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with K.
