The petitioner seeks bail in a case instituted for the offences under Sections 20, 22 and 24 of the N.D.P.S. Act. The prosecution case in short is that 60 kg ganja has been recovered in this case.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.1.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner was co-passenger of the vehicle. He had no knowledge that ganja is being kept in the car. Later on, the driver of the car disclosed that ganja belonged to Birendra Yadav and Arbind Yadav. Other co-accused has been granted
Patna High Court CR. MISC. No.45874 of 2019(2) dt.30-07-2019 2/2 bail vide Annexure-2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria in connection with Special Case No. 02 of 2019 corresponding to Raniganj P.S.
