JUSTICE SUDHIR SINGH ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 121, 121A and 124 of the Indian Penal Code and 3/4/5 of the Explosive Substance Act.

Allegation against the petitioner is that he is a member of Naxalite and on seeing police force he tried to flee away but he was apprehended. On the basis of his statement police recovered three bombs.

It has been submitted on behalf of the petitioner that he is in custody since 12.4.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. On the basis of confessional statement of the petitioner three live bombs are said to have been recovered. From perusal of the case diary it would appear that there is no such confession of this petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Case no. 20 of 2015.
