Patna High Court LPA No.405 of 2017(8) dt.23-02-2018 2/2 condoned.
Interlocutory Application stands allowed and disposed of. Re.: Letters Patent Appeal No.405 of 2017 This appeal arises out of an order passed on 09.02.2016 in Civil Writ Jurisdiction Case No.17228 of 2015 by a learned Writ Court. Challenging the same order, Letters Patent Appeal No.398 of 2017 (The State of Bihar & Ors. Versus Mukesh Kumar Singh) was filed by the State Government and on 10.01.2018, we had dismissed the Letters Patent Appeal filed by the State Government.
For the grounds and reasons already considered and discussed by us in the order passed on 10.01.2018 in Letters Patent Appeal No.398 of 2017 (The State of Bihar & Ors. Versus Mukesh Kumar Singh), we see no reason to make any indulgence into the matter. The appeal stands dismissed. (Rajendra Menon, CJ) ( Anil Kumar Upadhyay, J) Sunil/- U
