JUSTICE SUDHIR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 201 and 120B of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons had beaten the victim and caused her murder.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 5.7.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. F.I.R. has been instituted after 25 days for which no explanation has been made by the prosecution. From perusal of paras-27, 28, 29 and 30 of the case diary it would appear that the deceased had died due to illness. Other co-accused has been granted bail vide Cr. Misc. no. 42167 of 2015.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Case no. 96 of 2015.
