2. The petitioner seeks bail in connection with Mufassil P.S. Case No. 33 of 2022 registered for the offences punishable u/s 307, 147, 148, 149, 323 and 324 of the Indian Penal Code
3. As per the FIR, the allegation against the petitioner and other co-accused persons is that they entered into the house of the informant and made gunshot fire as a result of which his father sustained nose injury and fell down on the ground.
4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. From perusal of the FIR, there is no specific overt act
Patna High Court CR. MISC. No.53153 of 2024(4) dt.09-08-2024 2/2 alleged against the petitioner. There is general and omnibus allegation against this petitioner. The petitioner has no criminal antecedent and is in custody since 06.04.2024.
6. Having regard to the facts and circumstances of the case and considering that there is no specific overt act alleged against the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Mufassil P.S. Case No. 33 of 2022.
