Patna High Court C.Misc. No.629 of 2017(16) dt.28-01-2025 2/2 ORAL ORDER 28-01-2025 Heard learned counsel for the petitioners and learned counsel for the respondents.

The present civil miscellaneous petition has been filed for quashing the order dated 02.02.2017 passed by the learned Additional District Judge-VI, Nalanda at Biharsharif in Title Appeal No. 32 of 2014 whereby and whereunder the petition filed by the petitioner under Order 41 Rule 27 (2aa) of the Code of Civil Procedure has been rejected.

3. The learned counsel for the petitioners submits that Title Appeal No. 32 of 2014 has been dismissed for default and a Misc. Case No. 429 of 2023 has been filed for its restoration.

4. Be that as it may, since the aforesaid Title Appeal No. 32 of 2014, in which the impugned order has been passed, has been dismissed, this petition has become infructuous and the same is dismissed as such.
