It would appear from perusal of the first information report that it was co-accused, Chandan, who gave iron rod blow to the deceased as a result of which, deceased sustained injury. Although it is stated that petitioner and other FIR named accused assaulted the deceased with Lathi, but postmortem report of the deceased reveals that one external injury was found near the ear of the deceased. Although the doctor opined that the cause of death was head injury of the deceased but considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two
