JUSTICE SUDHIR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 201 and 120B of the Indian Penal Code. Allegation against the petitioner is that he is one of the accused who have caused death of the deceased by throwing him in the threshing machine.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 6.6.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Informant is not eye witness to the alleged occurrence. As per prosecution case, no specific allegation has been made against the petitioner. From perusal of para-21 of the case diary it would appear that it was an accidental death.
On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. and has actively participated in the alleged crime.

Case no. 72 of 2015.
